近年来,港澳與内地間的聯紧日益密切,港澳青年在内地的社會權保障問题愈發受到重視。保障港澳青年在内地的社會權有利於推動港澳青年與内地的深度融合;促進我國基本公共服務均等化優質化;落實新時代統一戰線工作的新要求目前港澳青年在内地的受教育權、勞動權、社會保障權的保障得到了一定發展,但在保障内容、方式等方面仍有較大限制,還无法享有與内地居民同等的權利。基於國家義務理論,對港澳青年社會權的完善至少包含尊重義務、給付義務和保護義務的内容。因此,對其社會權保障應先從弱化身份政治入手,同時通過提升保障措施可操作性與豐富度以落實國家給付義務。通過加強社會權的立法跟進與組織程序保障履行國家保護義務;明確法院對社會權救濟的絕對性義務。
In recent years, the connection between Hong Kong, Macao and the mainland has become increasingly close. The issue of social rights protection for young people from Hong Kong and Macao in mainland China is receiving increasing attention. Ensuring the social rights of Hong Kong and Macao youth is beneficial for promoting deep integration between Hong Kong and Macao youth and the mainland, promoting the equalization of basic public services in China, and implementing the new requirements of united front work in the new era. At present, the protection of the right to education, the right to work and the right to social security of Hong Kong and Macao youth in the mainland has been developed to a certain extent, but there are still large restrictions on the content and mode of protection, and they cannot enjoy the same rights as mainland residents. Based on the theory of national obligations, the improvement of the social rights of young people in Hong Kong and Macao should at least include the contents of respect obligations, offer obligations, and protection obligations. Therefore, the protection of their social rights should start with weakening identity politics and enhancing the operability and richness of the protection measures; To ensure the fulfillment of national protection obligations by strengthening legislation and organizational procedures for social rights; Clarify the absolute obligation of the court to provide
social rights relief.
